Welcome to Stammtisch. By accessing or using our mobile application, website, or related services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, joining a Stammtisch, submitting a form, or otherwise using the Service, you confirm that you have read and agree to these Terms and our Privacy Policy.

2. Description of Service

Stammtisch helps people organize recurring social gatherings. The Service may include group creation, invitations, join requests, date and location proposals, voting, RSVPs, reminders, photos, maps, place suggestions, streaks, trophies, and event history. Stammtisch provides coordination tools only. We do not organize, host, supervise, guarantee, or control the actual gatherings, venues, travel, reservations, food, drinks, or conduct of participants.

You retain ownership of content you submit, such as names, descriptions, photos, proposals, votes, RSVPs, comments, invitations, and venue submissions. You grant Stammtisch a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, modify for formatting, and distribute that content as needed to operate, secure, improve, and promote the Service.

You are responsible for your content. We may remove, restrict, or preserve content if we believe it violates these Terms, may create risk, may infringe rights, or may be required for legal, safety, or operational reasons.

6. Reporting, Moderation, and Safety

Users may contact us to report abusive users, unlawful content, unsafe behavior, privacy concerns, or inappropriate photos/groups. We may review reports, remove content, restrict accounts, block access, preserve evidence, or cooperate with lawful requests. We do not promise to monitor all content or resolve every dispute.

7. Events, Venues, and Real-World Gatherings

Users attend gatherings and visit venues at their own risk. Stammtisch is not responsible for:

Use common sense when meeting people, sharing locations, traveling, or attending events. If you need reservations or special accommodations, confirm directly with the venue.

8. Partner Venue Program

Venue listings or partner programs, where available, are intended to help groups discover places to meet. Stammtisch does not guarantee group volume, reservations, revenue, customer retention, rankings, or business outcomes. Venues remain responsible for licenses, health and safety obligations, offers, reservations, insurance, taxes, and customer service.

9. Paid Features and App Store Terms

Some features may be free, paid, trial-based, or limited by plan. If paid features are offered through Apple App Store, Google Play, or another payment provider, purchases, renewals, refunds, cancellations, taxes, and billing disputes may be governed by that provider's terms in addition to these Terms. Product availability and pricing may change.

10. Privacy and Data Security

Our data practices are described in our Privacy Policy. We use reasonable safeguards, but no system is perfectly secure. You are responsible for using appropriate account security and for choosing what information to share with groups or publicly visible areas.

11. Account Deletion and Termination

You may delete your account through the app where available or by contacting support. Account deletion may remove or anonymize your profile, authentication identity, memberships, and active personal data, but some information may remain in group event history, aggregated statistics, logs, backups, transactional emails, or records needed for safety, legal, or operational reasons.

We may suspend, restrict, or terminate accounts or access to the Service if we believe these Terms were violated, the Service may be harmed, users may be at risk, or we are required to do so by law.

12. Intellectual Property

The Service, including its design, software, branding, logos, and content created by Stammtisch, is owned by Stammtisch or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by law or with our permission.

13. Third-Party Services

The Service may rely on or link to third-party services such as Firebase/Google Cloud, Google Maps/Places, email providers, Formspree, Apple App Store, Google Play, analytics providers, and venues. We are not responsible for third-party services, websites, policies, outages, data practices, or content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR RELIABILITY.

We do not guarantee that the Service will be uninterrupted, secure, error-free, meet your requirements, prevent missed events, produce specific social outcomes, or ensure that gatherings happen as planned.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAMMTISCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICE, USER CONTENT, THIRD-PARTY SERVICES, OR REAL-WORLD EVENTS.

16. Indemnification

You agree to indemnify and hold harmless Stammtisch from claims, liabilities, damages, losses, and expenses arising from your use of the Service, your content, your violation of these Terms, your violation of law, or your interactions with users, venues, or third parties.

17. Changes to the Service or Terms

We may modify, suspend, or discontinue parts of the Service at any time. We may update these Terms from time to time by posting the updated version and changing the "Last Updated" date. Continued use after changes means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise.

19. Dispute Resolution

Before filing a claim, you agree to contact us and try to resolve the dispute informally. Any unresolved dispute will be handled in the state or federal courts located in California unless applicable law requires a different forum. If we later add arbitration terms, we will update these Terms before applying them.

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be limited or modified to the minimum extent necessary.
